Welcome to HerIdentity. These Terms of Service (“Terms”) govern your access to and use of the HerIdentity mobile application, website, Identity Pattern Assessment, HerLab subscription and related features and services collectively referred to as the “Service.”

These Terms form an agreement between you and Amanda Sprague, operating HerIdentity (“HerIdentity,” “we,” “us” or “our”).

By creating an account, purchasing a subscription, accessing the website or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

Users must be at least 13 years old to use HerIdentity. Users under the age of legal majority where they live must have permission from a parent or legal guardian to use the Service and agree to these Terms.

HerIdentity does not knowingly collect information from children under 13. If information from a child under 13 is discovered, users may contact support@heridentityapp.com so it can be investigated and deleted as required.

HerIdentity is designed primarily for women, but the Service does not exclude anyone who meets the eligibility requirements and finds the framework relevant.

2. Description of the Service

HerIdentity is an Identity Operating System designed to help users recognize the internal stories influencing their decisions, choose how they want to respond and build evidence of self-trust through aligned action.

Features may vary based on platform, subscription status, location, device compatibility and product availability.

3. Identity Patterns and Assessment

HerIdentity currently uses five nonclinical Identity Patterns:

Self-Doubter
Prover
Adapter
Safe Player
Settler

The Identity Pattern Assessment and related tools are intended for personal reflection and self-development. They are not psychological tests, medical evaluations, diagnoses or clinical assessments.

Your results do not permanently define you. You may recognize yourself in more than one pattern, and patterns may change in relevance over time. Within the app, you may select or change a Current Focus without changing your historical assessment results.

We do not guarantee that an assessment result will accurately describe every aspect of your experiences, personality or behavior.

4. Account Registration and Security

Certain features require an account. You agree to:

Provide accurate and current account information
Maintain the confidentiality of your login credentials
Notify us if you believe your account has been accessed without authorization
Accept responsibility for activity conducted through your account, except where prohibited by law

You may not share, sell or transfer your account to another person.

We may use third-party authentication providers, including email authentication, Google and Sign in with Apple.

5. Account Deletion

You may initiate deletion of your account through the app or contact us at support@heridentityapp.com for assistance.

Account deletion may permanently remove your profile and associated content, including decisions, journal entries, reflections, evidence records and coaching history, except for information we are legally required or permitted to retain.

Deleting your HerIdentity account does not automatically cancel an active Apple subscription. You must manage or cancel subscriptions separately through your Apple account settings.

The current Identity Coach allowance is up to three conversations per day. Technical limits, availability and the way usage is measured may be updated to maintain the Service.

HerLab premium experience

HerLab currently includes:

Unlimited AI coaching with memory, subject to reasonable-use and safety limits
The complete Recognize → Reframe → Embody protocol
Pattern Intelligence
Identity Portrait
Decision Throughline
Additional progress, evidence and milestone insights
Other premium features identified in the app

The purchase screen presented before payment controls if it differs from a general feature summary in these Terms.

We may improve, replace or discontinue individual features. We will not knowingly remove access to an active paid subscription without providing an appropriate remedy where required by law.

7. Premium Subscriptions and Billing

HerLab is currently offered at:

$14 per month
$97 per year

Applicable taxes may be added. Prices and available plans may vary by storefront or location. The price displayed through Apple at the time of purchase is the controlling price.

HerLab subscriptions:

Are billed in advance
Automatically renew unless canceled
Are processed through Apple’s App Store
Continue until canceled through your Apple subscription settings
Remain active through the end of the paid billing period after cancellation, unless otherwise stated by Apple

HerIdentity does not currently advertise a free trial. If a trial or promotional offer is introduced, its terms will be disclosed before enrollment.

Apple manages subscription billing, renewals, cancellations and eligible refunds. Refund requests are subject to Apple’s policies. Contact support@heridentityapp.com if you need assistance locating the appropriate subscription or refund process.

Deleting the app or deleting your HerIdentity account does not automatically cancel an Apple subscription.

If subscription pricing changes, notice and consent will be handled as required by Apple and applicable law.

8. AI-Powered Identity Coach

The Identity Coach uses artificial intelligence to generate responses based on information you provide, your activity within HerIdentity, the HerIdentity framework and, when enabled, relevant saved context.

The Identity Coach:

Is an automated system
Is not a human coach
Is not a licensed therapist, social worker, psychologist, physician or other healthcare professional
Does not provide medical, psychological, legal, financial or emergency advice
May generate incomplete, inaccurate or inappropriate responses
Should not be relied upon as the sole basis for significant personal, health, safety, legal or financial decisions

You are responsible for reviewing AI-generated responses and deciding whether or how to act on them.

Where required, personalized AI features will be subject to your consent and available privacy controls. Disabling personalized AI features may limit or change portions of the coaching experience.

9. Mental-Health and Crisis Disclaimer

HerIdentity is a self-development and reflection tool. It is not therapy, medical care, mental-health treatment, crisis intervention or a substitute for qualified professional support.

HerIdentity is not designed to diagnose, treat, prevent or cure any mental-health or medical condition.

If you believe you may harm yourself or someone else, are experiencing an emergency or need immediate assistance, contact local emergency services. In the United States, call or text 988 for the Suicide & Crisis Lifeline or call 911 in an emergency.

Do not use the Identity Coach or Sisterhood as an emergency-support service.

10. User Content

“User Content” means content you create, submit or share through the Service, including:

Journal entries
Daily decisions
Reflections
Identity Declarations
Assessment responses
Coaching messages
Evidence records
Sisterhood posts
Other information you provide

You retain ownership of your original User Content.

You grant HerIdentity a limited, nonexclusive, worldwide license to host, store, reproduce, process, transmit and display User Content only as reasonably necessary to:

Operate and provide the Service
Display your content back to you
Generate requested AI features
Maintain security and prevent misuse
Moderate Sisterhood content
Comply with legal obligations
Improve the Service as described in our Privacy Policy and applicable consent settings

This license ends when the content is deleted, except where continued retention is legally required, operationally necessary for limited backups or permitted under our Privacy Policy.

You represent that you have the right to submit your User Content and that it does not violate another person’s rights or applicable law.

11. The Sisterhood Community

The Sisterhood is an optional community feature where users may share reflections or practices.

Posts may be presented anonymously or without a public profile name, but anonymity cannot be guaranteed. Information included in a post may allow others to identify you. Do not share information you do not want other members to see.

Sisterhood content may be visible to other members of the Service but is not intended to appear publicly on the open internet.

When using the Sisterhood, you agree not to:

Harass, threaten, intimidate or target another person
Post hateful, discriminatory, exploitative or sexually explicit material
Encourage self-harm, violence or illegal activity
Share another person’s private information without permission
Impersonate another person
Post spam, scams, deceptive promotions or unauthorized advertising
Infringe intellectual-property or privacy rights
Use the community as a substitute for crisis or emergency services

We may review, restrict, remove or preserve reported content and may warn, suspend or terminate users who violate these Terms.

Users may have access to tools for reporting content and blocking other users. Contact support@heridentityapp.com to report safety or moderation concerns.

We cannot guarantee that all objectionable content will be identified or removed immediately.

12. Acceptable Use

You agree not to:

Use the Service for unlawful, fraudulent, abusive or harmful purposes
Attempt to gain unauthorized access to accounts, systems or data
Interfere with the operation or security of the Service
Introduce malware or malicious code
Scrape, crawl or extract content or data using automated methods without written permission
Use bots or automation to create accounts, manipulate engagement or burden the Service
Reverse engineer, decompile or attempt to extract source code except where such restrictions are prohibited by law
Share or resell account access
Circumvent subscription, usage, security or access controls
Use the Service to harass or harm another person
Upload content that violates applicable law or another person’s rights
Use HerIdentity content or outputs to create a competing commercial product without written permission
Misrepresent an affiliation with HerIdentity

13. Intellectual Property

The Service and its original content—including the HerIdentity name, branding, logos, illustrations, written materials, software, page designs and original expression of the HerIdentity framework—are owned by or licensed to HerIdentity and are protected by applicable intellectual-property laws.

This includes original HerIdentity materials related to:

The Three Laws of Identity
The Decision Filter
The Daily Identity Decision
Recognize → Reframe → Embody
Identity Pattern materials
HerIdentity exercises and guided practices

These Terms do not transfer ownership of HerIdentity intellectual property to you.

You receive a limited, personal, nonexclusive, nontransferable and revocable license to use the Service for your own noncommercial purposes while complying with these Terms.

Nothing in these Terms restricts rights that cannot legally be restricted, including applicable fair-use rights.

14. Third-Party Services

The Service may rely on third-party providers for hosting, authentication, AI processing, analytics if later enabled, subscription management, payment processing, transcription and other functionality.

Your use of certain third-party features may also be subject to those providers’ terms and privacy policies.

We are not responsible for third-party services outside our reasonable control, but we remain responsible for our obligations under applicable law.

15. Service Availability and Changes

We work to keep HerIdentity available and reliable, but we do not guarantee uninterrupted, error-free or permanently available access.

We may:

Update or improve the Service
Add, remove or modify features
Perform maintenance
Restrict access to protect users or systems
Discontinue portions of the Service

We will provide notice when reasonably required, particularly when a change materially affects an active paid subscription.

16. Suspension and Termination

You may stop using the Service at any time.

We may suspend or terminate access if we reasonably believe you:

Violated these Terms
Created a safety or security risk
Used the Service unlawfully
Abused another user or community feature
Attempted to circumvent payment or access controls

Where appropriate, we may provide notice and an opportunity to address the issue. Serious safety, security or legal concerns may require immediate action.

Termination does not automatically cancel an active Apple subscription. Subscription cancellation must be completed through Apple.

Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limitations and dispute provisions—will remain effective.

17. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available.”

HerIdentity does not guarantee:

Any particular personal, emotional, professional or financial outcome
That AI-generated content will be accurate or suitable
That assessment results will perfectly describe you
That the Service will always be uninterrupted or error-free
That use of the Service will replace professional support

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

18. Limitation of Liability

To the maximum extent permitted by law, HerIdentity and its owners, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to the Service.

HerIdentity is not responsible for decisions you make based on assessment results, AI-generated responses, community content or self-reflection tools.

Nothing in these Terms excludes liability that cannot legally be excluded or limits rights provided by applicable consumer-protection law.

19. Apple App Store Terms

If you access HerIdentity through Apple’s App Store:

These Terms are between you and HerIdentity, not Apple.
Apple is not responsible for operating, maintaining or supporting HerIdentity.
Apple is not responsible for claims relating to the Service except as required by law.
Your use of the app must comply with the App Store’s applicable terms.
Apple and its subsidiaries are intended third-party beneficiaries of the provisions applicable to the licensed iOS application and may enforce those provisions where permitted.

Apple’s Standard Licensed Application End User License Agreement may also apply to your use of the app. If there is a conflict concerning your App Store license, Apple’s applicable terms control.

20. Privacy

Our collection, use, retention and sharing of personal information are described in the HerIdentity Privacy Policy.

By using the Service, you acknowledge that you have reviewed the Privacy Policy.

21. Changes to These Terms

We may update these Terms as the Service or applicable requirements change.

When changes are material, we may provide notice through the Service, website, email or another reasonable method. The updated effective date will appear at the top of these Terms.

Your continued use after updated Terms take effect constitutes acceptance where permitted by law. If you do not agree to an update, you should stop using the Service and cancel any active subscription.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Before filing a formal claim, you agree to contact us at support@heridentityapp.com and provide a reasonable opportunity to resolve the concern informally.

Disputes arising from these Terms are subject to the jurisdiction of the courts located in San Diego County, California, except where applicable consumer law requires otherwise.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted as closely as possible to its intended lawful effect.

24. Entire Agreement

These Terms and the Privacy Policy constitute the agreement between you and HerIdentity concerning the Service, except for additional terms presented for a specific feature, promotion or purchase.
